CUSTOMER TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY, BY SIGNING UP FOR AND ACCESSING OUR SERVICES YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ACCEPT OUR PRIVACY POLICY. IF YOU DON’T WANT TO BE BOUND BY THESE TERMS AND CONDITIONS OR ACCEPT OUR PRIVACY POLICY, YOU SHOULD NOT REQUEST ANY SERVICES FROM US.

1.         About us

1.1.   Welcome to Cazaar! These terms govern your interaction with Cazaar, and by signing up for an account and using our online marketplace (the “platform”), you are agreeing to be bound by the following terms. (“Terms of Service”)

 

1.2.   Cazaar is owned and operated by ILFD Group Ltd a company registered in England and Wales under company registration number 07034824, with our registered office at Matrix House, 12-16 Lionel Road, Canvey Island, England, SS8 9DE.

 

1.3.   You may contact us at any time regarding your account or the services we provide at [email protected]

 

1.4.   In these terms Terms of Service “we”, “us”, “our” and “Cazaar” means ILFD Group Ltd and “you” means the user that has signed up to access the marketplace. References to “Seller” are the independent sellers on the platform.

 

2.         HOW THE MARKETPLACE WORKS

2.1.   Cazaar pronounced (Cuh – zaa) is a platform that allows users to purchase products from our selected Sellers on the platform.

 

2.2.   We provide you the customers with a platform where you can view, browse, sort filter and purchase products from our approved Sellers. We also provide you with a centralised access point to manage your orders, returns and control your account (the “Service”).

 

2.3.   In really simple terms, the customer journey works in the following way:

 

2.3.1.             You select the products you would like to purchase and add these to your basket;

 

2.3.2.             Once you are ready to checkout, click on the basket, fill in your payment and delivery details (which you may have saved form previous orders) and click checkout to proceed.

 

2.3.3.             After you have checked out, you will receive an email notification confirming acceptance accepted by the Seller. It is at this point a contract for your purchase is entered into between yourself and the Seller and an Order has been placed.

 

2.3.4.             If you do need to make a return, see section 5 which details how and when you can return items back to the Seller.

 

2.4.   Orders are only confirmed once you receive an email notification confirming that an Order has been processed.

 

3.         Customer Responsibilities

3.1.   In order to use the Service, you acknowledge and agree to the following:

3.1.1.             You must be at least 18 years old to use the Service;

 

3.1.2.             You agree to provide truthful and accurate information about yourself when registering for the services, including your name and contact information, you agree to keep this updated and current;

 

3.1.3.             You agree to keep your password and account details confidential and not share these with anyone;

 

3.1.4.             You agree to comply with our user policies, which can be found here;

 

3.1.5.             You will not attempt to  crawl, scrape, or spider any page of the Services or to reverse engineer or attempt to obtain the source code of the Services; and

 

3.1.6.             You will not in any way try to harm our systems or attempt to disrupt them.

 

4.         Cazaar Sellers

 

4.1.   All Sellers use our platform for commercial purposes.

 

4.2.   Whilst Cazaar may assist you in finding products from and purchasing these through the platform, you acknowledge and agree that Cazaar is not a party your contract with the Seller, nor is Cazaar responsible for fulfilling transactions.

 

4.3.   Save as may be excluded by law, you agree that Cazaar is not liable or responsible for any act or omission of the Sellers. To the extent that you have a disagreement with any Seller we encourage you to contact the Seller directly, their contact information will be displayed clearly on the platform.

 

5.         Returns and Refund process

 

5.1.   You may return items that are defective, damaged, or significantly not as described.

 

5.2.   You must make a return within 30 days from the date of delivery.

 

5.3.   To begin the returns process, please head over to your orders page, click on the drop down and select create return.

 

5.4.   Once you have filled out your reason for returning the item and it has been accepted. Please pack the item in its original packaging and attach a returns label to the front.

 

6.         Limitation of liability

 

6.1.   Save as may be excluded by applicable law, Cazaar, its affiliates, employees, agents or independent contractors shall not be liable to you for any direct losses and or indirect losses including but not limited to wasted expenditure, loss of profits, loss of data, loss of goodwill, business interruption, loss of us or loss of savings (in each case whether direct or indirect).

 

6.2.   Cazaar’s total aggregate liability to you arising out of or in connection with your use of the online platform shall not exceed £2,000.

 

6.3.   Your use of Cazaar’s services is solely at your risk. You acknowledge and agree that the service is provided on an “as is” and “as available” basis, without any warranty or condition whether express or implied. WE ARE EXPRESSLY DISCLAIMING ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AS WELL AS ANY WARRANTIES IMPLIED BY A COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE.

 

6.4.   To put this into context, any reliance you make on products purchased through our platform are solely at your risk. You understand that Cazaar does not produce, store or inspect our Seller’s items, we simply provide an online marketplace for these to be sold. For this reason we cannot make any warranty about the quality, safety, authenticity, or legality of any products on the platform. Any legal claim related to an item you purchase must be bought directly against the Seller of the item. You release Cazaar from any claims related to items that you purchase through the platform, including for defective items, misrepresentation by sellers, or any product liability claims.

 

6.5.   Nothing in these terms and conditions limits our liability, for death or personal injury arising from our negligence, fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law

8.         THIRD PARTY LINKS

 

8.1.   We may from time to time, provide links to other websites. These links are for informational purposes only and we do not have any control over their content including if they are factually correct. On that basis we do not accept any responsibility for any damage or loss you may suffer as a result of their use.

 

9.         TERMINATION

 

9.1.   You are always free to terminate your account with Cazaar at any time, although we would not like to see you go, you can close your account with us through your account dashboard.

 

9.2.   We may terminate or suspend your account (and any accounts we reasonably determine are related to your account) and your access to the Services should we have reason to believe you, or your use of the Services violate these Terms of Service.

9.3.   We do not want to terminate accounts immediately, and will normally provide you with notice if we consider that you have breached our terms, however if you have committed a serious breach of these terms or need to terminate immediately for legal or regulatory reasons, we will do so without notice.

 

10.   GENERAL

 

10.1.            We may change or update the platform at any time.

 

10.2.            We reserve all rights not expressly granted under these Terms and Conditions.

10.4.            Each clause of these terms and conditions operates separately from one another. If any court or relevant authority decided that any one of them are invalid, illegal or unenforceable, the remaining clauses shall remain in full force and effect.

 

10.5.            These terms and conditions, the privacy policy and any document expressly referred to in this agreement constitutes the entire agreement between you and us and supersedes any and all previous discussions, correspondence, negotiations, previous arrangements, understandings or agreements between us relating to the use of our platform and the Services made available on it.

 

10.6.            These Terms of Service are governed by English law and you or we can bring proceedings in respect of the Services in the English courts. If you live in Scotland you or we can bring legal proceedings in respect of the Services in either the Scottish or English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the Services in either the Northern Irish or English courts.
